2021 NDAA includes numerous provisions impacting government contracts

The National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2021 (Pub. L. No. 116-283) was enacted into law on January 1, 2021, when the Senate voted to override President Trump’s veto of the bill.

The Senate’s move, the final step in the legislative process, followed the House’s earlier vote to override President Trump’s veto in December 2020.

The FY21 NDAA sets funding levels and outlines policy priorities for the U.S. Department of Defense (DoD). It also addresses many areas of importance to government contractors, including acquisition policy and management, supply chain and industrial base matters, and small business issues.  The final version of the NDAA produced by negotiators on the Conference Committee included provisions from earlier House and Senate versions, which we summarized in an earlier article.

This article includes our annual summary, by topic, of the most relevant provisions of the FY21 NDAA for government contractors. As detailed below, some of the provisions from the earlier House and Senate versions of the NDAA that we highlighted in our previous article were not accepted into the final version.  As we’ve previously summarized, the NDAA also includes numerous provisions addressing cybersecurity and artificial intelligence policies with ramifications far beyond DoD, including implementing recommendations from the Cyberspace Solarium Commission’s 2020 Report.

DoD’s JAIC rolling out new contracts to speed up AI acquisition

The Defense Department has made no secret about its ambitions to employ commercial advances in artificial intelligence in military systems.

But adapting the government acquisition process to those technological developments is no small matter.

Three new contract vehicles the department is in the process of deploying should make things a whole lot easier — at least that’s the hope.

For starters, last month, the department’s Joint Artificial Intelligence Center reached an agreement that’s intended to create a rapid procurement process for AI. Defense officials are hopeful that the project, called Tradewind, will help the JAIC meet one of its core missions: Finding use cases for AI throughout the military and getting the right algorithms in the right places.

GSA kicks starts 2021 with an acquisition potpourri

When it comes to federal procurement, the General Services Administration takes no off days.

While the GSA’s Federal Acquisition Service employees will never be mistaken for elite athletes — where this concept of no days off comes from — they aren’t wasting any time setting up 2021 to be a busy year for contractors and for new governmentwide acquisition contracts.

In the span of two weeks, GSA released the draft solicitation for Polaris, the small business GWAC to replace the debacle that was Alliant 2 Small Business as well as two requests for information — one for artificial intelligence and machine learning capabilities, and one to develop a new professional services vehicle.

These initial pieces of market research or acquisition strategy planning come as GSA already is reviewing bids for spots under the 8(a) STARS III GWAC and the ASTRO program. GSA expects to make awards for both of these programs in spring 2021 or thereabouts.

New Pentagon initiative aims to help allies, contractors work together on AI

New tools are planned to help various militaries and defense companies cooperate and interoperate on artificial intelligence.

To better compete with China and Russia in developing artificial intelligence, the Defense Department will launch a new partnership with defense organizations from more than 10 nations, with more expected to join over the coming year, Defense Secretary Mark Esper recently announced.

The AI Partnership for Defense will “create new frameworks and tools for data sharing, cooperative development, and strengthened interoperability” across partner militaries, Esper said at the Joint Artificial Intelligence Center’s Symposium.  It will also help embed awareness and understanding of AI into contracting and training for personnel working in areas that include AI.

More details, including which nations will initially join the partnership, will become available soon, a Defense Department senior official said on background.

Esper said the Pentagon’s approach to AI development is more grounded in democratic values than those of China and Russia. “We are pioneering a vision for emerging technology that protects the U.S. Constitution and the sacred rights of all Americans. Abroad, we seek to promote the adoption of AI in a manner consistent with the values we share with our allies and partners: individual liberty, democracy, human rights, and respect for the rule of law, to name a few,” he said.

Pentagon seeks TurboTax-like tool for artificial intelligence purchases

It’s part of a new acquisition model that would explore the potential of pursuing contracts outside the Federal Acquisition Regulation, mixed with traditional contracts.

The Pentagon’s Joint Artificial Intelligence Center set sights on producing a new-and-improved business model for purchasing artificial intelligence tools in hopes of driving quicker procurement from both typical and non-traditional companies through a means that’s scalable across the Defense Department.

Together with Army Contracting Command Rock Island, the AI-strategizing center is considering launching a competition for a 501(c) or non-profit manager of the prototype model and would like to engage potential partners, according to a request for information published August 28.

The to-be-created model would incorporate a TurboTax-like automated system to streamline buying information.

The JAIC is also interested in hearing from organizations that would want to participate in a consortium-like body that could deliver AI capabilities for defense-driven missions under the model. Through the new approach, the center would leverage other transaction authorities, a contracting method that bypasses traditional federal procurement rules in an effort to attract new, innovative vendors and solutions.
