A reminder of the key provisions of the FY21 National Defense Authorization Act

Each year, Congress presents us in Title VIII of the National Defense Authorization Act (NDAA) a potpourri of procurement reforms, changes, and additions.

Some are effective immediately, while some are bound for rulemaking and regulation and surface years from enactment.

Some require analyses, reports, and studies which have no immediate impact but provide a roadmap that can and should be used by government contractors in their business planning.

Finally, some provisions of the NDAAs just wither away and have no impact whatsoever.

Nineteen days before the Trump Administration ended, the U.S. Senate followed the U.S. House of Representatives in overriding the President’s veto of the William (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (H.R. 6395) (FY2021 NDAA), making it law on January 1, 2021.  As for its Title VIII, the FY2021 NDAA is no different from its predecessors in its procurement potpourri.

Act now to enroll in September’s CON 170 cost and price analysis course

Georgia Tech’s course on the Fundamentals of Cost and Price Analysis (CON 170) provides expert instruction on fundamental quantitative pricing skills — skills so necessary to understand how the government makes contract pricing decisions.

The popular 10-day course is being offered September 16-27, 2019 on the Tech campus in the world-class Global Learning Center in Midtown Atlanta.  Registration details can be found here.

Attendees will learn how to accomplish Cost-Volume-Profit Analysis, calculate Contribution Margin Estimates, and develop Cost Estimating Relationships to achieve effective price analysis pursuant to FAR Subpart 15.4.  These are the skills needed to negotiate pricing of government contracts, subcontracts, and contract modifications.

Georgia Tech’s course includes an examination of the regulations and processes governing the use of cost analysis and requiring certified cost and pricing data.  The CON 170 course was originally developed by the Defense Acquisition University for aspiring Defense Department acquisition professionals.

After learning the basic elements of price and cost analysis, students receive instruction on how to build and defend a Pre-Negotiation Objective, including a minimum and maximum pricing objective with a Weighted Guidelines Assessment.  Students also learn how to defend pricing objectives by practicing face-to-face negotiations.

By attending, you’ll learn how to:

  • Identify the Government’s Pricing Objective
  • Review an Independent Government Cost Estimate
  • Apply Price-Related Factors
  • Review General Cost Principles on Allowability
  • Evaluate Direct and Indirect Costs
  • Determine the Applicability of Cost and Price Analysis
  • Practice Cost and Price Analysis Techniques
  • Conduct Cost Realism Analysis

Attendees receive instruction, a printed Student Guide to be used back on the job, valuable handouts, and exclusive web-based resources.  A complimentary breakfast is served each morning, along with snacks throughout each class day.

This is a federal core course, required for FAC-C and DAWIA certification.  Register here.

The Contracting Education Academy at Georgia Tech is an official Defense Acquisition University (DAU) equivalency training provider.  Georgia Tech’s coursework also is recognized by the Federal Acquisition Institute (FAI).

Hard-nosed Pentagon negotiator removed from job

Trump administration officials are removing the Pentagon’s top weapon buying negotiator, who racked up hundreds of thousands of dollars in travel costs and pushed a controversial plan to slow payments to defense contractors, Defense One has learned.
Shay D. Assad, Director, DoD’s Defense Pricing and Contracting Initiatives

Shay Assad, a senior Defense Department bureaucrat, is being reassigned to a post in Massachusetts, one unconnected to the contract negotiating team he has led for seven years, according to current and former defense officials familiar with the decision.

In the coming weeks, Assad will be moved from his position as director of defense pricing and contracting initiatives to a lateral position within the Defense Contract Management Agency in the Boston area, current and former officials said.
