DoD now awarding more than half its contract spending without competitive bids

Last week marks the two-year point since the Defense Department — worried that only 56.5 percent of its contracted dollars involved a meaningful competition between two or more vendors — issued a series of corrective actions to reverse a downward slide that’s been ongoing for nearly a decade.

 

So far, the results are not encouraging.

Data published by the Office of Defense Procurement and Acquisition Policy (DPAP) shows things have gotten worse, not better since those orders were signed. In each quarter of fiscal 2016 thus far, DoD’s overall competition rate has been below 50 percent, meaning something dramatic would have to happen in the fourth quarter for the department to meet its goal of 57 percent for the year.

Pentagon opens investigation into contracts with ULA

The internal watchdog for the U.S. Dept. of Defense (DoD) has opened a probe into whether the Pentagon’s contracts with United Launch Alliance (ULA) were properly awarded after a former ULA executive implied the government rigged a recent procurement in favor of the company.

The investigation inside the Pentagon is the latest twist in one of the space industry’s leading storylines in recent years — the contentious rivalry between ULA, the sole launch services provider for the U.S. government for nearly a decade, and newcomer SpaceX led by billionaire tycoon Elon Musk.

DoD’s inspector general is looking into assertions made by Brett Tobey, ULA’s former vice president of engineering, during a March 15 seminar at the University of Colorado-Boulder.

Tobey discussed ULA’s decision last year not to bid in a head-to-head competition with SpaceX for the launch of a Global Positioning System navigation satellite. At the time, ULA said it did not submit a proposal for the launch due to restrictions on the use of Russian engines on the Atlas 5 rocket and because it lacked accounting systems required in the structure of the Air Force’s request for bids.

IG: Navy and Marine Corps reasonably justified IT contracts with little or no competition

The Navy and Marine Corps reasonably justified about $220 million worth of IT contracts that were solicited without full and open competition, says the Defense Department’s inspector general in a report issued Jan. 23.

The IG reviewed 66 Navy and Marine Corps IT contracts that used “other than full and open competition” to procure technology services, with 34 being sole-source contracts and the other 32 limiting competition in some way.

The 34 sole-source contracts were valued at $151.5 million, with the rest coming in around $70 million, the report says.

House lawmakers call for OFPP to issue reverse auction guidance

House lawmakers are pressing the Office of Federal Procurement Policy to update the Federal Acquisition Regulations to detail how best agencies should use reverse auctions.

Reps. Jeff Miller (R-Fla.) and Sam Graves (R-Mo.), chairmen of the Veterans Affairs and Small Business committees, respectively, wrote to Anne Rung, OFPP administrator, Dec. 4, asking for a FAR case to be opened immediately to address reverse auctions.

“As you may well know, while our two committees recognize that reverse auctions, when properly used, may deliver savings to the taxpayer, we have long been concerned that some are misusing this tool to evade competition and compliance with other procurement regulations,” Graves and Miller wrote in the letter obtained by Federal News Radio.

Graves and Miller highlight findings from the December 2013 report from Government Accountability Office as well as recent GAO bid protest decisions detailing agency struggles with reverse auctions.

Acquisition planning is focus of July 14 course

Want to learn about the Government’s policies and procedures for planning an acquisition?  How does the Government deal with required and preferred sources of supplies and services?  What must be done to ensure competition?

To answer these questions and many, many more, The Contracting Education Academy at Georgia Tech is presenting a one-week course beginning July 14, 2014, entitled CON 090-2: Contract Planning in the FAR.

By attending this course, students will learn all the types of contracts that may be used in acquisitions, special contracting techniques, the impact of socioeconomic programs, the use of special contract terms and conditions, the implications of contractor qualifications, and proper advertisement procedures.

The course provides vital instruction for Government contracting personnel as well as important insights for contractors.

CON 090-2 is the second of four modules from CON 090 – Federal Acquisition Regulation (FAR) Fundamentals.  The Contracting Education Academy at Georgia Tech offers CON 090 in four, one-week classes.  Each module stands on its own, allowing students multiple opportunities throughout the year to complete the entire CON 090 course without the challenge of being away from work or home for an entire month.

The course consists of limited lecture, and is heavily exercise-based.  Students should be prepared to dedicate about an hour each evening for reading.

The Contracting Education Academy at Georgia Tech is an approved equivalency training provider to the Defense Acquisition University (DAU) and provides continuing education training to Acquisition and Government Contracting professionals as well as to business professionals working for government contractors or pursuing opportunities in the federal contracting arena.
