Bus brokerage exec admits to bribing Marine Corps official in exchange for $2 million in contracts

Darrel Fitzpatrick, who also went by the name Patrick Fields, pleaded guilty on January 21 to Conspiracy to Commit Bribery, in violation of Title 18, United States Code, Sections 371 and 201(b)(1).   Sentencing is set for April 29, 2021.

Fitzpatrick faces up to five years imprisonment, followed by three years of supervised release, a $250,000 fine, and a mandatory special assessment of $100.

According to court papers, in 2019:

  • Fitzpatrick was a senior account manager at a bus brokerage company in Atlanta that provided transportation to the U.S. Marine Corps Reserves.
  • That same year, Fitzpatrick started a competing transportation brokerage company called National Charter Express.
  • Fitzpatrick agreed to pay kickbacks to Erik Martin, a civilian employee of the Marine Corps Reserves, in exchange for Martin directing contracts to the company where he worked and, subsequently, to National Charter Express.
  • The conspiracy resulted in at least $2,000,000 in transportation contracts being corruptly awarded to companies associated with Fitzpatrick.
  • In exchange for the contract awards, Fitzpatrick wired and attempted to wire Martin over $250,000 in bribes.

The Defense Criminal Investigative Service (DCIS), the Naval Criminal Investigative Service (NCIS), and the United States Secret Service investigated this case.

Justice Dept. gets $9M back from bankrupt vendor

The federal government is exacting a little payback from Global Computer Enterprises in the form of a False Claims Act settlement.

After GCE applied for bankruptcy protection under Chapter 11 in September, the Labor Department and the General Services Administration had to pay the company $23 million to get access to financial systems and data.

Justice Dept. sealNow the Justice Department is collecting $9 million back after GCE and its owner Raed Muslimani agreed to settle charges brought against them.

DoJ said in a May 7 press release that GCE and Muslimani do not admit to any wrong doing, but agreed to pay the $9 million fine.

Justice brought up charges against GCE and Muslimani claiming the company “misrepresented and/or concealed that it was utilizing engineers and other employees who were expressly prohibited from working on the contracts due to their citizenship/immigration statuses,” in contracts with Labor, the Equal Employment Opportunity Commission (EEOC), GSA, the Secret Service and the Coast Guard.

Secret Service taking steps to strengthen certain acquisition policies, oversight, says DHS IG

The Secret Service has adequate oversight and management of its acquisitions, but it needs specific internal policies for acquisitions valued at less than $300 million – an issue that the agency is addressing, the Homeland Security Department’s inspector general said recently.

The IG’s revised audit dated Feb. 10 said the Secret Service should have its own policies and procedures and a designated “component acquisition executive,” or CAE, to strengthen its program. The agency should also integrate best practices into its daily operations, the report added.

“Taken together, these actions will decrease the risk of waste, fraud, and abuse and improve the Secret Service’s ability to acquire goods and services in a timely manner and at a reasonable cost,” the audit said.
