GAO: Most agencies still not providing complete data on contractors’ past performance

Although their level of compliance has improved over the last year, most federal agencies still haven’t met established governmentwide targets for providing complete, timely and accurate information on contractors’ past performance, congressional investigators found.

The Government Accountability Office (GAO) said compliance among the top 10 agencies – based on the number of contracts that each agency needed to evaluate – varied greatly, ranging from 13 percent to 83 percent, as of April.

Only two departments – Defense and Treasury – had compliance rates above 65 percent, said the GAO report released Aug. 7.

The Office of Federal Procurement Policy, or OFPP, which has been trying to improve agency compliance on this issue, had wanted all such departments to reach or exceed that 65-percent threshold by the end of fiscal 2013, GAO said.

President’s budget moves spending transparency site from GSA to Treasury

President Obama’s fiscal 2014 budget proposal moves control over the spending transparency website USASpending.gov out of the General Services Administration and gives it to the Treasury Department.

The budget also requests $5.5 million in additional funding for Treasury to manage the site, a Treasury spokeswoman said. The site was previously paid for with the e-government fund, a pot of congressionally-mandated money devoted to using the Internet and other electronic communications to improve citizen services and public access to government information.

“Treasury will conduct an analysis of the operation and information in USASpending and determine what changes in the medium or long term may be warranted,” the spokeswoman said. “The collection of government wide financial management information is closely aligned with Treasury responsibilities.”

Sequestration would cost civilian agencies $39 billion, contractor group says

Nondefense agencies would be hit with $39 billion in top-line budget cuts if the current law’s threat of sequestration kicks in on Jan. 2, 2013, according to new calculations by the Professional Services Council, a contractors trade group.

Though Congress and the White House could still reach a budget deal and head off the 2011 Budget Control Act’s requirement of across-the-board reductions, industry groups have been sounding the alarm about the short- and long-term harm the indiscriminate cuts would impose — particularly in defense.

In a pivot to the civilian agency side, the council recently analyzed sequestration’s likely impact on 16 nondefense agencies for fiscal 2013. It assumed that Congress will pass a six-month continuing resolution, as expected, and that fiscal 2012 enacted levels form the basis for applying the cuts.

House subpoenas four agencies for small-business noncompliance

Four federal agencies were issued subpoenas by the House Small Business Committee on Oct. 20 for not complying with the Small Business Act’s procurement policies, according to a committee staffer.

The departments of Justice, Agriculture, Treasury and State were summoned to appear before the the Small Business subcommittee on contracting and workforce on Nov. 1 to testify why they are in noncompliance.

At issue is the “structure” of these agencies’ Small and Disadvantaged Business Utilization Offices (OSDBU) and “the fact that they are not reporting to the agency head or deputy head,” wrote Darrell Jordon, house committee spokesman, in an e-mail to Washington Technology.

OSDBUs were conceived in 1978 with the purpose of having federal agencies set aside contracts for small and disadvantaged businesses. The Small Business Act also has requirements that agencies report their procurement activities with small and disadvantaged businesses.

Justice, Agriculture, Treasury and State were warned of their missteps and given a chance to remedy the situation after a June Government Accountability Office small business contracting report found seven agencies not in compliance.

Following that report, letters to agencies were sent by subcommittee Chairman Mick Mulvaney (R-SC). As a result, the Interior Department and Social Security Administration are now in compliance, and a third, the Commerce Department, was pardoned due to an administrative issue.

In September, agencies were reminded of their noncompliance by memo and a hearing was held on Sept. 15 by the subcommittee to examine the GAO report and the economic impact of noncompliance.

As part of the subpoena procedure, the four agencies must produce a number of documents, including paperwork relating to their small business procurement programs, attainment of small business goals or challenges to decisions not to restrict competition to small business between Jan. 20, 2009, and Sept. 30, 2011.
